These terms govern your engagement with Kasih and the use of our residential search and tenancy coordination services. We ask that you read them carefully. By submitting an enquiry or entering into a service arrangement with us, you agree to be bound by the terms set out below.
1. Definitions
The following terms are used throughout this document and carry the meanings assigned below:
- "Kasih", "we", "us", "our" — refers to Kasih, a residential property search and tenancy coordination service operating from Jalan SS 21/35, Damansara Utama, 47400 Petaling Jaya, Selangor, Malaysia.
- "You", "Client", "User" — refers to the individual or household engaging with our website or services.
- "Services" — refers to the residential search, tenancy coordination, and related advisory services described on our website and confirmed in writing between the parties.
- "Agreement" — refers to the binding engagement between you and Kasih, formed upon submission of a service enquiry and our written confirmation of service commencement.
- "Content" — refers to all written, photographic, and descriptive materials appearing on our website, including property notes, dossiers, and communications we prepare on your behalf.
- "Third Party" — refers to any property owner, managing agent, legal adviser, or other party not directly employed by Kasih but engaged in the course of delivering your search.
2. Acceptance of Terms
By using this website, submitting an enquiry, or engaging any of our services, you confirm that:
- You are at least 18 years of age or, where applicable, the age of majority in your jurisdiction.
- You have the legal capacity to enter into a binding agreement.
- You have read and understood these terms and agree to be bound by them.
- Where you are acting on behalf of a household or organisation, you have the authority to do so.
If you do not agree to these terms, please do not submit an enquiry or engage our services.
3. Service Description
Kasih provides residential property search and tenancy coordination services within the Damansara Utama, Damansara Kim, and Damansara Jaya districts of Petaling Jaya, Selangor. Our three current service arrangements are:
- Damansara Utama Residence Search — a patient search service for clients drawn to the character and rhythm of the Damansara districts, including pre-visits and honest written impressions before any viewing is arranged.
- Family Relocation & Tenancy Coordination — a full coordination service for families relocating into the Damansara area, covering school proximity, household logistics, lease review, and tenancy handover.
- Signature Damansara Residence Programme — a relationship-led service for clients seeking the upper tier of the Damansara residential market, including private viewings, dossiers, airport reception, and continuing concierge attention.
The precise scope of services will be confirmed in writing prior to the commencement of any engagement. Services are delivered in the English language. Geographic coverage is limited to the Damansara districts noted above; enquiries outside this area will be reviewed on a case-by-case basis.
4. Client Responsibilities
To enable us to conduct your search with care and accuracy, you agree to:
- Provide accurate, complete, and timely information regarding your household requirements, budget, preferred move-in timeline, and any specific conditions relevant to your search.
- Notify us promptly of any material change to your requirements, timeline, or financial circumstances that may affect the search.
- Attend scheduled viewings as agreed, or provide reasonable advance notice if you are unable to attend.
- Treat our written property notes, dossiers, and communications as confidential materials prepared for your personal use only.
- Deal with property owners and third parties in good faith during any viewing or negotiation facilitated by Kasih.
- Refrain from approaching a property owner or managing agent directly in respect of any property introduced to you by Kasih without our knowledge during the term of the engagement.
Prohibited conduct includes sharing our property materials with third parties without permission, misrepresenting your financial position or intentions to property owners, and any conduct that would reasonably damage our relationship with owners or agents in the Damansara area.
5. Intellectual Property
All written materials, property notes, dossiers, photographs commissioned by Kasih, and website content are the intellectual property of Kasih unless otherwise stated. These materials are provided to you under a limited, personal, non-transferable licence for the purpose of your residence search only.
You may not reproduce, distribute, publish, or share our materials in any form without our prior written consent. This includes sharing property dossiers with third parties or publishing extracts from our communications.
Photographs of properties provided by owners or their agents remain the property of those parties; we do not grant any additional rights in respect of third-party materials included in our communications.
6. Fees & Payment
Our service fees are as stated on our website at the time of engagement and confirmed in writing before the commencement of the service:
- Damansara Utama Residence Search — RM 2,390
- Family Relocation & Tenancy Coordination — RM 5,800
- Signature Damansara Residence Programme — RM 10,500
All fees are stated in Malaysian Ringgit (MYR) and are inclusive of applicable taxes unless otherwise noted. Payment terms, accepted methods, and instalment arrangements (where applicable) will be confirmed in your service agreement. We do not hold deposit funds on behalf of clients or property owners.
Fees paid for completed work are not refundable where services have been rendered in accordance with the agreed scope. Where a search is withdrawn by the client prior to viewing commencement, a partial credit may be extended at our discretion. Any credit arrangement will be confirmed in writing.
7. Service-Specific Terms
Residence Search: Our search service involves pre-visiting candidate properties and preparing written impressions for your review. We do not represent the property owner and act solely in the interests of the searching client. The selection of a property and the decision to proceed with any tenancy rests entirely with you.
Tenancy Coordination: Where we assist with lease review and tenancy documentation, this is provided as an organisational service and does not constitute legal advice. We recommend that you seek independent legal counsel before executing any tenancy agreement.
Signature Programme: Concierge and household staff introductions provided under the Signature Damansara Residence Programme are facilitatory only. We do not act as employer of record for any household staff and make no representations as to the suitability of individuals referred. Clients enter into any staff arrangements independently.
We do not provide property valuation, financial advice, or formal property management services. Any observations on rental pricing or market conditions are provided as informal context only.
8. Disclaimers
Our services are provided with care and sincere attention, but we cannot warrant specific outcomes. Property availability, owner decisions, and tenancy negotiations involve factors beyond our direct control.
We do not warrant that:
- Any property introduced will remain available throughout the search period.
- A tenancy will be successfully concluded within a specific timeframe.
- Our impressions of a property will align precisely with your personal assessment upon viewing.
- Third-party information provided by owners or agents, including property descriptions, utility estimates, or maintenance histories, is accurate or complete.
This website and its content are provided on an "as is" basis. While we make reasonable efforts to keep our information current and accurate, we do not warrant the completeness or timeliness of information published online.
9. Limitation of Liability
To the fullest extent permitted by Malaysian law, Kasih's total liability to you arising from or in connection with our services shall not exceed the total fees paid by you for the relevant service engagement.
We shall not be liable for:
- Indirect, consequential, or incidental losses, including loss of income, loss of business opportunity, or distress arising from the outcome of a tenancy search.
- Losses arising from the conduct, representations, or default of a third party including property owners, managing agents, or legal advisers.
- Losses arising from circumstances beyond our reasonable control, including changes in market conditions, regulatory developments, or events of force majeure.
- Losses arising from inaccurate information provided to us by the client.
10. Indemnification
You agree to indemnify and hold Kasih, its team members, and associated advisers harmless from any claim, loss, damage, or expense (including reasonable legal costs) arising from:
- Your breach of these terms or your service agreement with us.
- Inaccurate or misleading information you have provided to us or to a third party during the search process.
- Your conduct during property viewings, negotiations, or tenancy arrangements facilitated by Kasih.
11. Termination
By you: You may withdraw from a service engagement at any time by notifying us in writing. Where work has commenced, fees for completed stages of the service are retained in accordance with Section 6.
By Kasih: We may suspend or conclude a service engagement if you breach these terms, provide materially inaccurate information, or engage in conduct that we reasonably consider incompatible with our working relationship or with the interests of property owners in the Damansara districts. In such cases, we will notify you in writing and retain fees for work completed to that point.
Effect of termination: Upon conclusion of an engagement, your licence to use our property materials ends. The provisions of Sections 4 (client conduct regarding introduced properties), 5 (intellectual property), 9 (limitation of liability), and 10 (indemnification) survive termination.
12. Dispute Resolution
These terms are governed by and construed in accordance with the laws of Malaysia. Any dispute arising out of or relating to these terms or your engagement with Kasih shall be subject to the exclusive jurisdiction of the courts of Malaysia.
We encourage the resolution of any concern through direct discussion in the first instance. If you have a complaint or concern, please contact us at [email protected] and we will respond within 10 business days. Most concerns can be resolved through open, considered conversation.
Where informal resolution is not achieved, disputes may be referred to mediation under the auspices of the Malaysian Mediation Centre before proceeding to litigation, should both parties agree to this process.
13. General Provisions
- Entire Agreement: These terms, together with any written service agreement or confirmation between us, constitute the entire agreement between you and Kasih in respect of the services described.
- Severability: If any provision of these terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
- Waiver: Our failure to enforce any provision of these terms on any occasion shall not constitute a waiver of our right to do so on a future occasion.
- Assignment: You may not assign or transfer your rights under a service agreement without our prior written consent. We may assign our obligations to a successor in the event of a business restructure, provided that the quality and scope of your service is not materially affected.
- Notices: Formal notices under these terms should be sent in writing to Kasih at Jalan SS 21/35, Damansara Utama, 47400 Petaling Jaya, Selangor, or by email to [email protected].
14. Changes to These Terms
We may update these terms from time to time to reflect changes in our services or applicable law. When we do, we will revise the "Last updated" date above. Where changes are material, we will notify active clients directly by email.
Continued use of our website or services following publication of updated terms constitutes your acceptance of those changes. If you do not accept the revised terms, please notify us and we will discuss the implications for any ongoing engagement.
